Q. Explain School Code and State Aid Schools of Choice.
A. Schools of Choice is a section 105 and 105C State Aid Act Law. It is not in the School Code. It has to be part of the state aid act to be implemented. It has been amended since original State Aid Act inclusion in 1996. Found in PA 119 of 1999 State Aid Act section 105 and 105C.
Q. Is Board resolution necessary?
A. Yes. A Board resolution is necessary when a district opts-in or opts-out of the state 105/105C plan. It is not necessary to do every year, only when changing. Board resolution should be sent to MDE. If districts change from a mutual agreement district to a 105/105c district, a Board resolution is necessary.
